General Terms and Conditions (GTC)

1. SCOPE OF APPLICATION
1.1 These General Terms and Conditions apply to the sale and delivery of goods to consumers by the company LAROCHE - Die Genusswelt Frankreichs, Laroche KG, based in 2753 Markt Piesting, Meitzgasse 7a, Commercial Register No. 505417k.
1.2 Placing an order for goods offered by Laroche implies full acceptance of these GTC.
1.3 Laroche is authorized to amend these GTC at any time. The version valid at the time of the customer's order, as published on the online shop, shall apply.
2. PRICES
2.1 Prices refer to the goods only and do not include shipping costs. All costs arising from shipping, including any import or export duties, are to be borne by the buyer. Prices are listed in Euro including the applicable VAT. All invoices are issued and payable in Euro. Exchange and transfer fees are to be borne by the buyer.
2.2 Free Shipping: For orders with a gross value of EUR 75.00 or more, Laroche covers the delivery costs within Austria, Germany, and the BeNeLux countries. This excludes "En Primeur" (Subskription) wines and clearance items. For all other European countries, actual shipping costs will be charged and displayed during the checkout process.
2.3 Deliveries are standardly shipped in certified PTZ wine packaging via GLS. Each package is insured up to EUR 450.00. For higher values, Laroche recommends additional insurance or splitting the shipment into multiple packages at the buyer's expense.
2.4 Laroche reserves the right to change prices at any time. The applicable price is the one listed at the time of purchase.
3. PAYMENT AND DEPOSITS
3.1 The purchase price is due upon ordering, or at the latest upon delivery. This also applies to partial deliveries.
3.2 If delivery is agreed upon, shipping costs and any optional insurance requested by the buyer will be charged separately and are due upon delivery.
3.3 Laroche retains ownership of all goods until full payment of the purchase price and any ancillary fees.
3.4 For special orders, a deposit of at least 50% of the purchase price is required immediately after order confirmation.
3.5 Discounts do not apply to "En Primeur" subscriptions or already discounted goods.
3.6 In the event of payment default, a reminder fee of up to 10% of the purchase price (minimum EUR 5.00) will be charged. If payment is not received, Laroche is entitled to appoint a collection agency.
3.7 Payments can be made via bank transfer, credit card (PayPal), or cash upon collection.
4. TRANSFER OF RISK
4.1 For self-collection, the risk passes to the buyer upon handover of the goods.
4.2 For deliveries, the risk passes to the buyer upon handover at the buyer's front door. Shipping liability is limited to EUR 450.00 per package unless additional insurance was purchased.
5. RETURNS AND CANCELLATIONS
5.1 Right of Withdrawal: Consumers have the right to withdraw from the contract within 14 business days of receiving the goods for orders placed electronically or via phone. Withdrawal must be sent to boutique@lavinothequelaroche.com. The buyer bears the return shipping costs. Cancellation of special orders is generally excluded and subject to a fee of at least 50%.
5.2 Voluntary Returns: Laroche may accept returns of undamaged, originally packed goods within 7 days against a store credit. This excludes special orders, promotions, and partial quantities from original cases (OHK/CBO).
6. ORDERS
6.1 Orders are accepted via phone, fax, email, or the online shop. The customer must ensure proper acceptance of the goods at the specified delivery location and time.
6.2 In case of non-acceptance of ordered goods, Laroche is entitled to demand compensation for wasted shipping and handling costs.
6.3 Photos on the website are symbolic; labels and bottle shapes may vary from the delivered product.
7. WARRANTY AND LIABILITY
7.1 All goods are subject to statutory warranty. Non-conforming products will be replaced or refunded.
7.2 In accordance with international customs, Laroche is not liable for "corked" wine (cork taint). However, Laroche will attempt to find a satisfactory solution with the producer.
7.3 All complaints or refund requests must be made in writing within 10 days of delivery.
8. EN PRIMEUR (SUBSCRIPTIONS)
8.1 Subscriptions allow for the reservation of wines for delivery at a later date. A reservation is only binding once confirmed by Laroche and paid in full by the buyer.
8.2 Delivery dates depend on the producers' release dates. If a delivery fails, the deposit will be refunded in full; there is no claim for a replacement product.
8.3 A 100% deposit is due within 14 days of confirmation via bank transfer. PayPal/Credit card is only accepted if the buyer covers the transaction fees.
9. PROTECTION OF MINORS
9.1 The sale and delivery of wine and spirits are restricted to persons over the age of 18. Laroche is entitled to request official photo identification before handing over the goods.
10. DATA PROTECTION
10.1 Buyer data is stored and processed solely for contract fulfillment and customer care. Data will not be shared with third parties. Buyers have the right to access and rectify their data.
11. COPYRIGHT
11.1 All elements of the online shop are the intellectual property of Laroche and are protected by copyright.
12. MISCELLANEOUS
12.1 If individual provisions are invalid, the remainder of the contract remains in force.
12.2 The place of performance and jurisdiction is Wiener Neustadt, Austria.
12.3 The contract is subject to Austrian law. For EU consumers, the consumer protection laws of their country of residence also apply.
